While Daltik's head office is located in Brazil, for all transactions made by customers in Australia, these Terms shall be governed by the laws of Australia, with primary regard to the ACL. Daltik is the party legally responsible to the Australian customer for the fulfillment of orders and the satisfaction of consumer guarantees.

 

3. Orders, Pricing, and Product Availability

 

 

A. Pricing and Currency

 

All prices displayed on the Site are in Australian Dollars (AUD) and are inclusive of the Australian Goods and Services Tax (GST), where applicable. We reserve the right to change prices at any time without prior notice.

 

B. Order Acceptance

 

The placement of an order constitutes an offer to purchase, not a contract. Order acceptance is subject to payment verification and product availability. We reserve the right to refuse or cancel any order for reasons including, but not limited to, limitations on quantities, errors in product or pricing information, or suspected fraud.

 

C. Stock and Availability

 

We only list products that are in our physical inventory. If a product becomes unavailable after your order is confirmed and paid—which can occasionally happen due to inventory synchronization delays—we will notify you immediately and issue a full, prompt refund.

 

4. Shipping and Fulfillment

 

 

A. Fulfillment Model Transparency (Crucial Change)

 

By placing an order, you acknowledge that Daltik operates an international distribution model. Products are shipped from Daltik's controlled distribution centers located internationally (e.g., Europe, Asia, and the United States) after processing. Daltik owns the inventory at the time of purchase. This centralized distribution allows us to efficiently manage inventory for imported and national clothing.

 

B. Delivery Timeframes and Cost

 

  • Shipping Cost: Shipping is FREE on all orders.
  • Timeframe: You agree to the total estimated delivery time of 7–14 Business Days, as fully detailed and explained in our Shipping Policy.
  • Delays: We are not liable for delays outside our reasonable control (e.g., customs, carrier issues). However, we are committed to providing continuous customer service and resolution for any substantial delay.

 

5. Returns, Refunds, and Guarantees

 

Your rights regarding returns are detailed in our separate Returns & Refund Policy. By agreeing to these Terms, you agree to that policy, which explicitly covers:

  • Consumer Guarantees (ACL): Your right to a remedy (replacement, repair, or refund) for faulty or defective goods.
  • "Change of Mind" Returns: Our commitment to a 30-day unconditional return period for unworn, unused clothing.

You guarantee that all information provided during the purchase process (including name, address, and payment details) is current, complete, and accurate.

 

B. Intellectual Property

C. Limitation of Liability
